Terms of Service

1. Acceptance of terms
By creating an account, signing a subscription order, or otherwise using Weed POS, you agree to these Terms of Service on behalf of your dispensary. If you do not agree, do not use the service. Only representatives authorized to bind your business may accept these terms.
2. The service
Weed POS provides a cloud-based point-of-sale and retail operations platform tailored to Oklahoma OMMA-licensed cannabis dispensaries. The service includes the modules described on weedpos.us — POS, METRC compliance, inventory, loyalty, customer segments, deals, calendar, HR, expenses, and reports — together with implementation, support, and ongoing updates as outlined in your subscription agreement.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Weed POS for the operation of your licensed dispensary during the term of your subscription. The license is bound to the locations identified in your subscription order; using Weed POS at unlicensed locations is prohibited.
4. Acceptable use
You agree to use Weed POS only for lawful cannabis retail operations that comply with Oklahoma law and OMMA program rules. You will not (a) attempt to reverse-engineer the service, (b) interfere with the integrity or performance of the platform, (c) use the service to transmit malware, or (d) misuse patient or employee data accessible through the system.
5. Fees and payment
Fees are stated in your subscription order. Unless otherwise agreed, fees are billed monthly and due within 14 days of invoice. Late balances accrue interest at the lower of 1% per month or the maximum permitted by law. All fees are exclusive of applicable taxes, which are your responsibility.
6. Customer data
You retain ownership of all data your dispensary generates within Weed POS. We process that data solely to provide and improve the service, and as described in our Privacy Policy. On termination you may export your data within the window specified in your subscription order. We will assist with reasonable migration requests at no additional cost.
7. Compliance
Weed POS is built to support OMMA compliance, but you remain responsible for the legal operation of your dispensary, including license validity, employee training, and the accuracy of information you submit through the service. We do not provide legal advice; nothing in the service constitutes a substitute for counsel licensed in Oklahoma.
8. Suspension and termination
We may suspend access for non-payment, suspected fraud, or violation of these terms, with reasonable notice where practical. Either party may terminate the subscription for material breach if the breach is not cured within 30 days of written notice. On termination your data export rights apply as described in §6.
9. Warranty disclaimer
The service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, although we take reasonable steps to maintain availability.
10. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, arising from this agreement. Aggregate liability for direct damages is capped at the fees you paid us in the 12 months before the event giving rise to the claim.
11. Governing law
These terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. The parties consent to exclusive jurisdiction in the state and federal courts located in Oklahoma County, Oklahoma.
12. Changes to terms
We may update these terms when our service or legal obligations change. Material changes will be communicated to active operators by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised terms.
